This document sets forth the binding terms and conditions governing the use of the Website, which apply to all users and visitors of the Website, as well as the terms governing the purchase of products through the Website.
Users are also encouraged to review the Privacy Policy separately. A link to the Privacy Policy is available in the footer section of the Website and can be accessed by scrolling to the bottom of the homepage.
The Website is established and operated by the Business. The Business is located at Histadrut Street, Holon, Israel, and may be contacted via email at Hive.8te@gmail.com.
These Terms are drafted in the masculine form for convenience only and shall apply equally to all genders.
1. General
The use of the Website and the information contained therein, as well as any purchase made through the Website, are subject to these Terms of Use and Purchase. Users are therefore requested to carefully review this document. These Terms are binding and may not be modified by users. By using the Website, accessing its content, or placing an order, the user acknowledges and agrees to these Terms. If any provision of these Terms is unacceptable to you, you must refrain from using the Website.
Users undertake to comply with these Terms in connection with any use of the Website. As circumstances may change from time to time, the Business reserves the right to amend, modify, or update these Terms at its sole discretion. Where required, notice of material changes shall be provided in advance.
The use of the Website and the purchase of products through it constitute the user's confirmation that they have read, understood, and agreed to these Terms. These Terms constitute a legally binding agreement between the user and the Business.
These Terms apply to the use of the Website and all services available through it, whether accessed via a computer, mobile phone, tablet, or any other communication device, and whether accessed through the Internet or any other communication method.
Nothing contained in these Terms shall derogate from the provisions of the Israeli Consumer Protection Law, 1981, and the regulations enacted thereunder, to the extent that such provisions apply to the Website, except where applicable law expressly permits otherwise.
The Business makes reasonable efforts to present complete and accurate information regarding its products, including product descriptions and images. However, the Website may occasionally contain inaccuracies, typographical errors, omissions, or other unintended mistakes relating to products offered for sale. Users acknowledge and accept this possibility, and the Business shall not be liable for non-material inaccuracies or errors.
Product images displayed on the Website are provided for illustrative purposes only. Minor differences may exist between the appearance of a product as displayed on the Website and the actual product received, including differences in color, shade, size, positioning, or other visual characteristics.
As the products sold through the Website are made-to-order Print-on-Demand (POD) apparel products, slight variations in print placement, color tone, garment dimensions, or manufacturing details may occur and shall not be considered defects or non-conformities.
Any date, time, record, or transaction information recorded in the Business's systems shall constitute conclusive evidence of the relevant event and shall be deemed the determining record for all purposes.
2. Registration and General Conditions
For the purposes of these Terms, any person seeking to place an order through the Website, including any person who has placed an order and holds a valid credit card issued by a recognized credit card company, shall be referred to as the "Customer."
The Website offers for sale Print-on-Demand (POD) apparel and fashion products, including custom-designed clothing and accessories under the HIVE brand.
The products are manufactured in Bangladesh. The Business is not the manufacturer of the products but acts as an intermediary between the manufacturer, production partners, and the Customer.
To place an order, Customers must follow the instructions provided on the Website, enter the required information, and complete their purchase as a guest.
Any individual, business entity, corporation, partnership, or other legal organization that is legally capable of entering into binding agreements may use the Website and purchase products through it.
Customer information shall be updated and maintained according to the details provided by the Customer during the checkout process.
For the purpose of fulfilling orders and performing its obligations, the Business may require additional identification details or supporting information from the Customer.
Without derogating from any other right available to the Business, the Business reserves the right, at its sole discretion and without prior notice, to temporarily or permanently deny access to the Website or refuse service in any of the following circumstances:
a. The Customer has committed an unlawful act or violated applicable law;
b. The Customer has violated any provision of these Terms;
c. The Customer knowingly provided false, inaccurate, or misleading information;
d. The Customer performed any action that may interfere with the proper operation of the Website, its service providers, or any third party;
e. The Customer's payment method, including a credit card, has been restricted, suspended, blocked, or declined.
3. Orders and Product Purchases
The Website enables Customers to conveniently, securely, and efficiently purchase products through its online store.
Products may be purchased at any time, subject to product availability and the sole discretion of the Business.
Products are purchased by adding selected items to the shopping cart and completing the checkout process.
During checkout, the Customer will be required to provide certain information, including but not limited to:

Shipping and delivery information.
The Customer must also provide accurate delivery information, including the recipient's full name, telephone number, city, street address, building number, apartment number (if applicable), and any additional information that may assist the delivery carrier in successfully delivering the order.
Fields marked as mandatory must be completed in order to finalize an order.
To prevent delivery issues, the Customer is responsible for providing accurate, complete, and up-to-date information. The accuracy of such information is a fundamental condition for processing and fulfilling the order.
The Customer acknowledges that all information submitted during checkout shall be deemed accurate and complete. The Business shall not be responsible for delays, failed deliveries, additional shipping costs, or any other issues resulting from inaccurate, incomplete, or misleading information provided by the Customer.
3. Orders and Product Purchases (Continued)
Upon completion of the checkout process, the Customer shall confirm the order details and the accuracy of all information provided. Once confirmed, the order shall be deemed completed (the "Order").
Upon receipt of the Order, and only after payment authorization has been successfully approved by the relevant payment provider, and subject to product availability, the Order shall be forwarded for production, preparation, and shipment.
The information entered by the Customer during checkout shall serve as conclusive evidence of its accuracy. Accordingly, the Customer shall have no claim, complaint, demand, or cause of action against the Business regarding the fulfillment or delivery of the Order where any issue arises as a result of inaccurate, incomplete, or incorrect information provided by the Customer.
All prices displayed on the Website include VAT where required by applicable law.
The Business reserves the right, at its sole discretion, to discontinue the sale of any product at any time, as well as to modify product pricing without prior notice.
After payment information has been submitted through the checkout process, the Customer will receive an email confirming receipt of the Order details. Such confirmation does not constitute acceptance of the Order by the Business and does not guarantee product availability or fulfillment. It merely confirms that the Order details have been successfully received by the Website's system.
4. Payment
Payment for products purchased through the Website shall be made using a valid credit card or any other payment method approved by the Business.
Where the Customer elects to pay by credit card, the Customer may be required to provide payment-related information necessary to process the transaction.
For security purposes, payment information is not stored by and is not accessible to the Business. All payment processing is performed through the Business's authorized third-party payment provider, PAYPLUS.
The Business reserves the right, at its sole discretion, to discontinue, restrict, add, or modify available payment methods, as well as to apply different payment arrangements to different payment providers, card issuers, or payment methods.
Following submission of the Order, the selected payment method will be verified by the payment processor. Upon successful authorization, the Customer will receive confirmation that the Order has been approved and that the applicable charge has been processed.
If the transaction is declined, rejected, canceled, or otherwise not approved by the payment provider, credit card issuer, or any other payment service, the Customer shall be notified accordingly and the Order shall not be completed.
Order fulfillment is subject to product availability at the time of processing. In the event that a product becomes unavailable after an Order has been placed, the Business may cancel the Order and issue a full refund for any amount paid, or otherwise void the transaction. In such circumstances, the Customer shall have no claim against the Business beyond the refund of the amount paid.
If the Customer believes that they have been charged incorrectly, the Customer must notify the Business promptly so that the matter may be reviewed and, where appropriate, a refund or adjustment may be issued.
5. Delivery and Shipping
Product delivery is carried out through independent third-party shipping and logistics providers. The Business may assist Customers in resolving shipping-related matters where reasonably possible; however, the Business does not perform shipping services directly.
Customers are responsible for providing accurate and complete shipping information. If an Order is returned due to an incorrect address, incomplete information, failure to collect the shipment, refusal to accept delivery, or unavailability of the recipient, the Customer may be responsible for any additional shipping, handling, storage, or re-delivery charges incurred.
The Business will make reasonable efforts to ensure that products are delivered within 22 business days from the date the Order is approved and payment authorization is successfully completed.
As the products sold through the Website are made-to-order Print-on-Demand products, production and fulfillment begin only after an Order has been successfully placed and approved. Delivery times are estimates only and may vary depending on production schedules, shipping carriers, customs procedures, destination country, peak seasons, and other factors beyond the Business's control.
Shipping fees, where applicable, shall be charged together with the purchase price of the products. The Customer acknowledges that the purchase of products and the shipping services associated with their delivery constitute separate services, even when charged together during checkout.
The Business shall not be liable for delays, interruptions, or failures in delivery resulting from circumstances beyond its reasonable control, including but not limited to force majeure events, war, military operations, national emergencies, natural disasters, labor disputes, strikes, transportation disruptions, customs delays, supplier delays, production interruptions, governmental actions, or issues attributable to third-party shipping providers.
5. Delivery and Shipping (Continued)
Customers are responsible for providing accurate, complete, and up-to-date shipping information. If an Order is returned due to incorrect shipping details, an incomplete address, failure to accept delivery, or the recipient's unavailability, the Customer may be charged additional shipping, handling, storage, or re-delivery fees.
The Business will make reasonable efforts to ensure delivery of the purchased products within 22 business days from the date the Order is completed and payment authorization is successfully approved.
As HIVE operates on a Print-on-Demand (POD) model, products are manufactured only after an Order has been placed. Production and shipping times may therefore vary depending on product availability, manufacturing schedules, shipping destinations, customs procedures, carrier performance, peak demand periods, and other factors beyond the Business's control.
Shipping fees shall be paid together with the purchase price of the products. However, the Customer acknowledges that the purchase of products and the provision of shipping services constitute separate services. Where payment is made in installments, the Business may charge shipping fees together with the first payment installment.
The Business shall not be liable for delays, interruptions, or failures in delivery caused by circumstances beyond its reasonable control, including but not limited to force majeure events, war, military operations, national emergencies, natural disasters, labor disputes, strikes, transportation disruptions, supplier delays, manufacturing interruptions, customs delays, governmental actions, or issues attributable to third-party shipping carriers.
6. Cancellation, Returns, Refunds, and Inventory Errors
6.1 Made-to-Order Products
The products sold through the Website are manufactured specifically upon receipt of each Order and are not maintained as pre-produced inventory. Accordingly, products are created and fulfilled on a made-to-order Print-on-Demand basis.
6.2 Defective, Damaged, or Incorrect Products
If a product arrives damaged, defective, misprinted, or materially different from the product ordered, the Customer must contact the Business within 30 days of receiving the product by sending a written request to:

The Customer may be required to provide photographs, supporting documentation, or other evidence reasonably requested by the Business in order to investigate the claim.
Upon verification of the issue, the Business may, at its sole discretion:

Replace the product;

Reproduce and reship the product;

Issue a full or partial refund; or
-
Provide another reasonable remedy.
6.3 Lost Packages
Claims relating to packages lost during transit must be submitted no later than 30 days after the estimated delivery date.
6.4 Returns Due to Change of Mind
Except where otherwise required by applicable law, the Business does not provide refunds, returns, or exchanges due to:

Customer preference;

Ordering errors made by the Customer.
6.5 Returned Shipments
If a shipment is returned due to an incorrect address, failure to collect the shipment, refusal of delivery, or any other reason attributable to the Customer, the Business reserves the right to charge additional shipping and handling fees before re-shipping the Order.
6.6 Cancellation by the Business
The Business reserves the right, at any time and at its sole discretion, to cancel, suspend, refuse, or discontinue any Order, transaction, product listing, sale, or Website activity, in whole or in part.
In such circumstances, the Customer shall be notified accordingly and any payment received for products not supplied shall be refunded.
6.7 Inventory and Availability Errors
While the Business makes reasonable efforts to maintain accurate inventory and product availability information, errors may occasionally occur.
If a product becomes unavailable after an Order has been placed, the Business may:

Offer the Customer a comparable replacement product of equal value.
The Customer acknowledges that inventory discrepancies and technical errors may occur and agrees that the Business shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from inventory inaccuracies, stock shortages, or availability errors.
7. Intellectual Property
All intellectual property rights associated with the Website are the exclusive property of HIVE, its owners, licensors, or authorized rights holders. These rights include, without limitation, copyrights, trademarks, trade dress, designs, logos, graphics, product descriptions, creative materials, website content, software, trade secrets, and any other proprietary materials appearing on the Website.
7. Intellectual Property
All intellectual property rights associated with the Website are the exclusive property of HIVE or are used under a valid license or authorization granted to the Business.
Such intellectual property rights include, without limitation, copyrights, trademarks, trade names, logos, product designs, website designs, trade dress, commercial secrets, creative content, graphics, images, text, software, databases, and any other proprietary materials appearing on the Website.
These rights apply, among other things, to the Website's content, product listings, product descriptions, product designs, creative materials, branding elements, the Website name HIVE, the domain name officialhive.store, and all trademarks, whether registered or unregistered.
All such rights remain the exclusive property of the Business or their respective rights holders. No user is granted any ownership, license, or other rights in relation to any intellectual property appearing on the Website.
Without the prior written consent of the Business, users may not copy, reproduce, distribute, publish, display, modify, create derivative works from, sell, license, exploit, or otherwise use any content, material, information, or intellectual property appearing on the Website.
Any unauthorized use of the Website's intellectual property may constitute a violation of applicable intellectual property laws and may entitle the Business to seek all available legal remedies.
8. Customer Support
HIVE operates a customer support service with the goal of providing an efficient and positive customer experience.

Customer support is available Sunday through Thursday between 17:00 and 22:00 (Israel Time).
The Business aims to respond to customer inquiries within 48 hours, excluding weekends, public holidays, holiday eves, and circumstances beyond the Business's reasonable control.
9. Warranty and Customer Service
The Business is responsible for supplying products that materially correspond to the products ordered by the Customer.
However, the Business shall not be responsible for claims relating to product quality except where such claims involve a material defect, manufacturing defect, or material non-conformity attributable to the Business or its production partners.
The Business shall not be liable for damage resulting from improper, unreasonable, negligent, or unintended use of a product.
Product Care Instructions
To maintain the quality and longevity of HIVE products, Customers should follow these care instructions:

Machine wash cold and inside-out on a gentle cycle with similar colors.

Use mild detergent only.

Do not use fabric softeners.

Use non-chlorine bleach only when necessary.

Tumble dry on low heat or hang dry.

Iron inside-out using a cool setting.

Never iron directly on printed designs.

Do not dry clean.
Failure to follow these instructions may result in fading, cracking, shrinkage, print deterioration, or other damage for which the Business shall not be responsible.
Upon receipt of the products, the Customer shall inspect them promptly.
Any claim relating to a defect, damage, printing error, manufacturing issue, or material non-conformity must be submitted to the Business as soon as possible and no later than 48 hours after delivery, together with photographs and any supporting information reasonably requested by the Business.
In the event of a defect or material non-conformity, the Business reserves the right to require proof that the claimant is the original purchaser of the product.
Where a defect or material non-conformity is verified, the Business may, at its sole discretion:

Repair the product;

Replace the product;
-
Reproduce and reship the product; or
-
Provide another appropriate remedy.
The Customer acknowledges that the remedies listed above constitute the sole and exclusive remedies available in connection with defective or non-conforming products.
Under no circumstances shall the total liability of the Business exceed the amount actually paid for the affected product.
10. Information Security and Privacy
The Business employs reasonable administrative, physical, and technical safeguards designed to protect the privacy of its users and the confidentiality of information provided through the Website.
Users are encouraged to review the Business's Privacy Policy, which is available through the Website footer and may be accessed at any time through the Website.
While the Business takes reasonable measures to safeguard information, no method of electronic transmission or storage is completely secure. Accordingly, the Business cannot guarantee absolute security and shall not be liable for events beyond its reasonable control.
11. Governing Law and Jurisdiction
These Terms of Use and Purchase shall be governed exclusively by the laws of the State of Israel.
Any dispute, claim, controversy, or legal proceeding arising out of or relating to these Terms, the Website, any purchase made through the Website, or any related activity shall be governed and interpreted solely in accordance with Israeli law.
The competent courts of the State of Israel shall have exclusive jurisdiction over any dispute arising in connection with these Terms, subject to any mandatory provisions of applicable law.
12. Chargebacks and Payment Disputes
Customers agree to contact HIVE before initiating any chargeback, payment dispute, or claim with their credit card issuer, payment provider, or financial institution.
The Business reserves the right to present order records, payment confirmations, production records, shipment tracking information, delivery confirmations, customer communications, and any other relevant documentation as evidence in response to any chargeback or payment dispute.
Fraudulent or abusive chargebacks may result in the suspension or permanent restriction of future purchases through the Website.
13. Delivered Packages and Lost or Stolen Shipments
Once a shipment has been marked as delivered by the shipping carrier to the address provided by the Customer, responsibility for the package transfers to the recipient.
The Business shall not be responsible for packages that are lost, stolen, misplaced, damaged, or otherwise unavailable after delivery has been confirmed by the shipping carrier.
Customers are encouraged to ensure that the delivery address provided is secure and accessible for receiving shipments.
If a package is believed to be lost in transit before delivery is confirmed, the Customer must contact the Business within 30 days of the estimated delivery date so that an investigation may be initiated with the carrier.
14. Intellectual Property Infringement Claims
HIVE respects the intellectual property rights of others and expects its users to do the same.
If any person believes that content appearing on the Website infringes upon their copyright, trademark, or other intellectual property rights, they should submit a written notice containing sufficient details of the alleged infringement to:
